Update 9th June 2011 UPPER House MP Bernard Finnigan turned up at Parliament for a ridiculous self-indulgent cameo today.  The fat pervert selfish in the extreme, not even giving the government the respect to stay around for more than a few minutes The former leader of the Government in the Upper House appeared at 4.35pm and left after eight minutes at 4.43pm.   He resumed his seat on the back bench on the Government side on the chamber, but did not make any comment or contribute to the debate.  

Mr Finnigan refused to explain his absence for seven straight sittings to reporters and would not say if he intended to keep his seat.   He walked slowly to the carpark before driving off.  Under parliamentary rules, MPs are automatically dismissed from office if they miss 12 consecutive sitting days without being granted leave, traditionally allowed in instances of sickness.   Mr Finnigan missed seven sitting days and was required to attend before June 23 to avoid being sacked, and forfeiting his $130,000 base salary, access to an office and staff as well as subsidised car and phone use.  His appearance yesterday means he can remain absent until September 14.   He only needed to attend Parliament today long enough to have his appearance noted to win another 12-sitting day reprieve from expulsion.

UPDATE 20/05/11 here is his court case number 223 AMC-11-4367 F, B.V. (SUPPRESSED) what a joke.  The slime bag appeared in court today and will appear in court again in August.  I wonder who is paying this fat slimy slobs legal bills?  He is hiding behind the fact he has not entered a plea to hoping to stop himself being revealed … Too late sicko!  The disgraced politician at the centre of child pornography allegations made his first court appearance at Adelaide’s Magistrates Court today!  The man, who has yet to plead to multiple counts of child pornography offences, arrived at court just before 10am.  He was accompanied by his lawyer Michael Abbott, QC, and his solicitor Dominic Agresta.  The trio walked silently through a large media pack and entered the court.  Oh don’t they wish they could say more my friends… Section 71A of the Evidence Act (1929) bans the media from publishing any evidence tendered, or submission made, in the Magistrates Court relating to an alleged sex offence.

L uckily I am not the media and as all this information is publicly available on the internet.   I take snippets from various sources and do not claim to represent them.I choose to reproduce it here.  Alleged offenders can only be named and submissions reported, when they enter a plea to the charges.  This was the case in 1929!!!   As he left court, the man and Mr Agresta were involved in a scuffle with a reporter.

Courts sheriff officers ejected the reporter from the court, and banned him from the building for 24 hours. The man, who is on bail, will appear in court again in August.

UPDATE 24/04/11 Rann’s Press Conference, so much for an open government, just stick your head in the sand Rann!  It will go away Mr Rann declined to give any support to Mr Finnigan yesterday when asked if he should quit politics. “That’s up to Mr Finnigan and those matters will be dealt with at a later stage,” Mr Rann said.  Opposition education spokesman David Pisoni said Labor must explain why Mr Finnigan resigned as minister.

“When Mr Finnigan was announced as minister 72 days earlier there was great fanfare,” Mr Pisoni said.  “The Premier has been silent on the reasons for Mr Finnigan leaving the ministry – South Australians deserve an explanation, why did we see such a sudden departure of Mr Finnigan?”  Is it totally a coincidence?  NO ITS NOT .. that South Australian MP and acting Police Minister Bernard Finnigan has resigned from Cabinet today?  Premier Mike Rann announced this morning that he had accepted Mr Finnigan’s resignation from Cabinet and Executive Council.  Bernard Finnigan being sworn in, now busted with kiddie porn .. PREMIER Mike Rann says he is shocked by reports of an MP being charged with serious criminal offences involving alleged possession of child pornography.

The MP at the centre of the allegations has been identified as a Labor MP but a six-paragraph statement released by Mr Rann makes no mention of the MP’s political affiliations.  “For legal reasons, no person, including me as Premier, is at liberty to reveal the identity of the person, the subject of the allegations, or to disclose any information through which others may infer the identity of the person,” Mr Rann said.  “It would be against the law for me to comment on the allegations as the matter is now before the courts.  “I believe that any potential witnesses with any evidence or information about these allegations must co-operate fully with police.”

Mr Rann said the Government would, of course, co-operate with the police in the investigation. The MP was taken to the City Watchhouse on Wednesday night, charged with four child pornography offences and later released on police bail.  He will appear in Adelaide Magistrates Court on May 20. Detectives said their investigation was continuing. Under SA law he cannot be identified until his committal, unless he gives his consent.  He returned home earlier today but had not spoken to the waiting media outside. Politicians from both sides say they are shocked by the allegations.

Police said the arrest was the result of the Sexual Crime Investigation Branch’s ongoing “Operation Decimate”, which targets people who use the internet for child exploitation-related offences.  The maximum penalty for possessing child pornography in South Australia is five years in jail for a first offence. The maximum penalty for an aggravated offence in seven years in jail.  Section 63 of the Criminal Law Consolidation Act 1935 says that an aggravated offence includes an offender knowing that the victim was aged under 14 at the time, or the offence being committed in the company of one or more other people.  It is believed several laptops were seized from the MP’s suburban home.  Turmoil swept state political circles as details of the incident emerged.

There were reports that police visited the MP’s office at Parliament House but this was denied by the presiding officers, who have to give permission for police to enter the building.  Legislative Council President Bob Sneath said he had not been approached by police and Speaker Lyn Breuer said she had not been contacted by police.  Ms Breuer said she was “certainly concerned about the issue”.  Labor and Liberal MPs were in shock last night and few were prepared to talk about the incident. Many were asking the media for details.

A spokeswoman for Opposition Leader Isobel Redmond said she could not comment.  It is understood the MP’s home was raided on Tuesday afternoon and police spent 24 hours analysing the contents of a computer.  Yesterday, they went to the MP’s office and seized another computer for analysis.  Last night, police returned to the MP’s house.  One officer emerged from the house about 7.35pm and went to a police car. He then carried what appeared to be a tape back into the house.  At 7.55pm, two detectives wearing gloves searched a car parked in the driveway.  They examined the boot and under the seats before returning to the house. Police left the house at 8.10pm carrying several evidence bags containing compact discs and a mobile phone and the house was shut and left in darkness.

Why the MP charged with alleged child pornography offences cannot be named THE name of the Labor MP charged with child pornography offences will remain a state secret for months thanks to an 35-year-old law.  Absolute rubbish, should be one law for all… It is further banned from naming any person charged with an offence, and must not identify anyone alleged to be a victim. The act defines a sex crime as “any offence involving sexual exploitation or abuse of a child, or exploitation of a child as an object of prurient interest”.  The act says alleged offenders can only be named once they have entered a plea – be it guilty or not guilty – to the charges, and have been remanded for either sentence or trial.
