The experts report with a psychiatrist booked for October 2011 was cancelled due to numerous delays by the icl and mentions where the child was not discussed. Interim orders proposed by the icl recommended that the child return to her fathers care at the start of January, before any evidence was looked at. The mothers affidavit has 5 mentions of the fathers suicide attempt history and the fact that he has been threatening to the child that he will kill himself if she doesn't stay with him. The child has divulged this to her psychologist and it is in the notes. The affidavit was listed in 2 business days due to 'urgency' in July 2011. The experts report was rescheduled by the icl for April 2012 - 3+ months AFTER the child was to move back to the father. The mother found another court approved psychiatrist able to do the report in December 2011 - which would have meant scrutiny prior to moving the child. Icl (now christos Christaki) refused without valid reason. Both mother and father were ordered to pay half the 10,000 cost for report. Father refused to pay, and he doesn't want scrutiny, and the option provided is the mother pays or the report doesn't happen. Mothers application for legal aid refused despite her financial circumstances dictating she is entitled to it. Mother borrows money from family to cover report. Interviews are conducted 2 April 2012. Report is received on first day of hearing so it gets adjourned. Report states father admits to and medical records show that he stabbed himself in the stomach with a knife in front of the child recently, slapped her in the face, that the child is being neglected and is in the adult role, the child has been severely alienated from her mother by the father and grandmother and that the mother is the person in the child's life most capable of fulfilling all her needs. Despite this, the icl continues to support the child living with her father. Child has been emailing mother asking for recipes and a maths tutor. Childs school will not return mothers calls when she phones to ask maths teacher to recommend tutor and to speak to girls supervisor to ask them to make sure her daughter has food and is dressed suitably etc. Child is raising herself and is experiencing psychological, physical and emotional abuse and neglect. Legal aid will not waiver from their original position because it shows they were wrong, dropped the ball. And had they read and taken note of the concerns raised in July 2011 none of this would have happened. |

She bullied me (the client) at the court during negotiations by standing over me and shouting at me and pushing me to give more time with the children to an abuser, failed to provide historical evidence of violence to the court, failed to obtain medical adjournment from court when I became physically ill and forced me to go on, said that my studying at uni would go against me (turns out that is bs) and threatened that I would get no contact due to the 'expert' report. All this was bs and my next lawyer from the Legal Aid headquarters stated that the children were too old for all the garbage Ms McGee talked about and the matter should never have been in court in the first place if I had a decent lawyer. New lawyer also stated that McGee would worm her way out of any complaints process and not to bother lodging a complaint about her after my children were assaulted by their father. I had told McGee that he had a history of violence however she convinced me not to speak up about it. One child was repeatedly assaulted and eventually concussed and the other bruised, neglected and terrified out of his wits til I received an urgent order so that the older one never had to see the father again and the younger one only if s/he chose to, due to the violence. McGee is a liar, a bully and an idiot when it comes to children's safety. |
